Regal Membership — Terms of Service & Membership Agreement

These Terms of Service and Membership Agreement (“Terms”) are a binding agreement between you (“you,” “Member”) and Regal Weight Loss LLC (“Regal,” “we,” “us,” or “our”), a Texas limited liability company. By enrolling in The Regal Membership, creating an account, or using our website at regalweightloss.com and join.regalweightloss.com (the “Service”), you agree to these Terms. If you do not agree, do not enroll in or use the Service.
1. The Regal Membership
The Regal Membership is a wellness coaching and accountability membership. It includes weekly accountability check-ins, certified nutritional coaching, behavior-change and habit support, member resources, and member support. The membership is a coaching and educational service. It is not medical care.
2. Not Medical Advice; Independent Medical Provider
Regal Weight Loss is not a medical provider and does not provide medical advice, diagnosis, treatment, or prescriptions. Any medical evaluations, lab review, and prescription decisions are provided by an independent, licensed third-party medical provider with whom the patient/provider relationship is formed directly. Your membership with Regal is separate from, and not conditioned upon, any medical services you may obtain from a third party. Nothing in the Service establishes a physician-patient relationship with Regal.
Always consult a qualified healthcare professional before beginning any weight loss, nutrition, or exercise program. Individual results vary and are not guaranteed.
3. Membership Fees, Term, and Recurring Billing Authorization
Please read this section carefully — it authorizes recurring charges.
- Fee. The Regal Membership is $150.00 per month (or such other amount shown to you at the time of enrollment).
- Minimum term. Membership has a three (3) month minimum commitment, after which it continues on a month-to-month basis until cancelled.
- Authorization. By enrolling and providing a payment method, you authorize Regal Weight Loss LLC to automatically charge your payment method on file the monthly membership fee, on a recurring monthly basis, beginning on your enrollment date and on or about the same day each month thereafter, until your membership is cancelled in accordance with these Terms. You authorize these charges to recur without requiring your signature or further authorization for each charge.
- Card on file. Your payment method is stored in tokenized form by our payment processor for the purpose of processing recurring charges.
- Failed payments. If a charge is declined, we may retry the charge and may contact you to update your payment method. Your membership may be suspended or cancelled if payment is not received.
- Price changes. We may change membership fees on at least thirty (30) days’ notice; continued membership after the effective date constitutes acceptance.
4. Cancellation
After your three-month minimum commitment, you may cancel at any time by contacting us at the email or phone number below. Cancellation stops future recurring charges. Cancellation requests must be received before your next billing date to avoid being charged for the upcoming month.
5. Refunds
Except where required by law, membership fees are non-refundable, including fees paid during the minimum commitment period. Cancelling stops future charges but does not refund charges already incurred.
6. Payment Processing
Payments are processed by our third-party payment processor, Intuit QuickBooks Payments. By enrolling, you also agree to the applicable terms of the payment processor. We do not store your full payment card number; it is handled by the processor in accordance with PCI-DSS standards.
7. Communications Consent
By providing your phone number and email, you consent to receive membership-related communications, including account, billing, and appointment messages by email and SMS text message. Message and data rates may apply. You may opt out of promotional texts by replying STOP; transactional messages necessary to operate your account may still be sent.
8. Member Responsibilities
You agree to provide accurate information, keep your payment method and contact details current, use the Service only for lawful purposes, and not misuse, disrupt, or attempt unauthorized access to the Service. You are responsible for maintaining the confidentiality of your account.
9. Intellectual Property
All content, materials, and resources provided through the Service are owned by or licensed to Regal Weight Loss LLC and are provided for your personal, non-commercial use as a Member. You may not copy, redistribute, or resell them.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant any particular health, weight, or wellness outcome. Individual results vary.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REGAL WEIGHT LOSS LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Regal Weight Loss LLC from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Service.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date and, where appropriate, communicated to you. Continued use of the Service after changes take effect constitutes acceptance.
